Some new regulations on post-clearance inspection

According to the provisions of the Customs Law No. 54/2014/QH13 and guiding documents, post-customs clearance inspection (KTSTQ) is carried out at the headquarters of the customs office and the headquarters of the customs declarant.

Regulations on post-clearance audit at the headquarters of the customs office have many changes in terms of methods, methods and competence compared to the old regulations (Article 79 of the Customs Law No. 54):

- Old regulations: The law does not stipulate the form of inspection, so when the customs authority sends an invitation/notice of inspection to the customs declarant, the time limit for inspection is not specified. The postal audit can only be done at the head office of the Sub-Department of Postal Audit.

- Current new regulations: There are specific regulations on the form and time of inspection. Accordingly, the customs authority must issue the decision on post-clearance audit at the headquarters of the customs authority, the time limit for inspection is specified in the decision and must not exceed 05 working days. The new law also stipulates that the authority to decide on inspection includes the Director of the Customs Department and the Director of the Customs Sub-Department. Accordingly, the postal audit at the headquarters of the customs authority shall be carried out at the Sub-department of Post-Presentation and the Sub-Department of Customs where the declaration is registered.

Previously, the customs authority managed through the activity of reviewing dossiers, but the method was only for each shipment, each declaration should be of an individual nature. According to the new regulations, at the Customs Sub-Departments that carry out customs clearance procedures, through each shipment, high-risk objects and items will be aggregated to focus on quick and timely inspection, avoiding the phenomenon of Fraud persisted and became commonplace.
