On May 12, 2015, the Ministry of Finance issued Circular No. 72/2015/TT-BTC stipulating the application of priority regime in the implementation of customs procedures, customs inspection and supervision for goods. export and import of enterprises. In particular, it is noteworthy that the new regulation on security and safety for priority businesses.
The Priority Enterprise Program (DNUT) of Vietnam Customs has been researched and implemented since 2011, based on the AEO (Authorised Economic Operator) program as recommended by the World Customs Organization (WCO). However, this program is only aimed at creating trade facilitation for eligible businesses, but has not focused much on security and safety issues.
Towards the long-term goal of signing mutual recognition agreements (MRAs) on DNUT with customs of other countries, it is necessary to improve the legal basis to be more consistent with the regulations of some countries.
Circular No. 72/2015/TT-BTC dated May 12, 2015 of the Ministry of Finance replacing Circular No. 86/2013/TT-BTC has studied additional conditions on security and safety as a part of the condition. on the internal control system of the enterprise (Clause 2, Article 16), specifically:
Enterprises have internal control measures, means and processes to ensure the security and safety of the supply chain of exported and imported goods as follows:
a. Monitoring the process of transporting goods from the enterprise to the port and from the port to the enterprise;
b. Safety inspection of containers before loading the goods onto the means of transport;
c. Monitoring at important positions: Area fences, entrance gates, warehouses, production areas, administrative areas;
d. Delegating employees to move and work in areas suitable to their tasks;
D. Information technology system security control;
e. Personnel security.”
In addition to other requirements, the inclusion of security and safety content (including cargo safety, information security security, personnel security, ...) into Circular No. 72/2015/TT -BTC has gradually improved the legal basis, creating conditions for Vietnam Customs to seek the possibility of signing MRA with Customs of other countries, enhancing the effectiveness of the DNUT program.
