The Ministry of Information and Communications has just issued Circular No. 18/2014/TT-BTTTT dated November 26, 2014 detailing the implementation of Decree No. 187/2013/ND-CP dated November 20, 2013 of the Government. for the granting of licenses to import radio transmitters, receivers and transmitters.

The Circular stipulates conditions, order and procedures for granting and re-granting import permits, cases in which import permits are exempted, and a list of specific items according to HS codes for microwave equipment; equipment that transmits, receives and transmits radio waves with a frequency band between 9 KHz and 400 GHz and a capacity of 60 mW or more (collectively referred to as radio transmitters, receivers and transmitters) in the specialized management of the Ministry of Information and Communications.

Radio transmitters, receivers and transmitters that must have an import license are complete equipment with technical characteristics and descriptions of goods in accordance with technical specifications, design structures, and can operate independently. ; does not apply to components or accessories of these radio transmitters, receivers and transmitters and does not include equipment that only receives radio waves.

The list of radio transmitters, receivers and transmitters requiring an import license is specified in Appendix I of this Circular and applies only to radio transmitters, receivers and transmitters but also codes for radio transmitters and receivers. HS number and description of goods coincide with HS code and description of goods on the list.

Imported radio transmitters, receivers and transmitters must satisfy the following conditions: Conformity with technical regulations and standards promulgated or announced for compulsory application by the Ministry of Information and Communications; in accordance with the equipment installation location and regulations on telecommunications management; in accordance with the Radio Frequency Planning, regulations on use of radio frequencies and import purposes.

Equipment that does not meet the above conditions or is imported for special purposes shall follow the instructions of the Ministry of Information and Communications for each specific case.

Radio transmitters, receivers and transmitters specified in Appendix I of this Circular are exempt from import permits in the following cases:

- Radio transmitters, receivers and transmitters of: diplomatic missions, consulates of foreign countries, representative offices of international organizations in Vietnam; Foreign high-ranking delegations visiting Vietnam are entitled to diplomatic privileges and immunities; foreign reporters engaged in non-resident press activities in Vietnam (having a press operation license from the Ministry of Foreign Affairs).

When using, these devices must be licensed by the Radio Frequency Department in accordance with current regulations.

- Terrestrial mobile phones (not exempt from import license for satellite mobile phones) consigned with or not on the same trip of people entering the country or imported by post or international delivery service for personal use; Terrestrial mobile phones are temporarily exported or re-imported for warranty, repair or replacement purposes, provided they are still within the warranty period under the import contract.

The Department of Telecommunications under the Ministry of Information and Communications is the agency that issues licenses to import radio transmitters, receivers and transmitters.
This Circular takes effect from January 16, 2015.
